[NEWS] DBSK to Appear Together as Five in Japan

TVXQ//DBSK is going to appear on Japanese television with all five members together. It will be their first public appearance together in almost 3 months, since they have not been seen together after their Osaka concert which happened on August 30th.

They will appear on Nihon TV's "Best Hit Music Award 2009" on coming 26th and Fuji TV's "FNS Music Award" on December 2nd. They are also planning on attending NHK's "Red White Kohaku" and "Japan Record Awards". Members will soon part for Japan in order to plan their schedules for these end of year ceremonies.

Although Jaejoong, Yoochun and Junsu are legally independent of SM Entertainment now, they are still bound to AVEX, their Japanese management. As long as their contract with AVEX stands, they are to carry on with their Japanese schedules.

Mnet's '2009 Mnet Asian Music Awards (MAMA)' vowed to become a music festival of Asia and started off with a bang.

MAMA was held at the Jamshil Indoor Gymnasium at 7 pm on the 21st. This event was broadcasted through Mnet and KMTV in, not only Korea, but the ten major Asian nations Japan, China, Thailand, Taiwan, Hong Kong, Philippines, Macao, Malaysia, Indonesia and Singapore.

Three members of DBSK, Micky Yoochun, Xiah Junsu, and YoungWoong Jaejoong, who are caught in a legal dispute with their agency SM Entertainment, did not follow the footsteps of the agency and instead announced their attendance of the awards ceremony and many are curious of the future of DBSK.

DBSK fans who were on location sang a DBSK song together as the commercials were playing at the end of Act 1 to show their love for them. They also waved their red balloons and shouted "DBSK" to show their belief that DBSK would last forever.

[INFO] DBSK Trio After MNet's Asian Music Awards

YoongWoong Jaejoong cried backstage. Cassiopeia entered the resting room and kept on crying, Yoochun cried and Junsu was telling him not to. When they left, their manager was not with them. There wasn’t any body around. No bodyguards. Not even a proper method of transportation. They went off in a van.

Yoochunnie was about to burst in tears, when they were walking down the stage he was hiding his face in his hands. Junsu was on the phone, they (Cassiopeians in attendence) assume he’s trying to call the other boys beccause he said something like "we should call them."

Yoochun's mom was there with the three boys and she was crying because Chunnie looked heartbroken as well.

All in all it was a very touching yet sad evening for the boys, us fans and anyone else linked to this. T____T

And I thought it was bad when they were giving their speech T___T

DBSK members Youngwoong Jaejoong, Xiah Junsu and Micky Yoochun showed up at the Mnet Asian Music Awards (MAMA) as promised and delivered a very heartwarming acceptance speech.

On the 21st, DBSK was awarded the "Best Representative for Asia//Best Asia Star" award.

Xiah Junsu stated:
"It's been a long time. It's an honor just to be able to attend such a huge event, but being able to receive an award, thank you so much. This award is not for one single member, but because all 5 members have put forth so much effort we are able to receive it. Thank you so much to all of our fans in Asia for allowing us to receive such a huge award."

Micky Yoochun stated:
"I think this is the first time I've wanted to sing so badly. After becoming a singer, I was able to meet such great members, that's why I think we are able to be here. We will work even harder to expand beyond Asia. We hope for even more support than now."

Youngwoong Jaejoong stated:
"I can't be happier because this award is coming directly from the fans of Asia. To our fans who are watching and possibly our two friends who are watching, I wanted to say that I love you."

Three members of group DBSK stated that an unauthorized use of their signatures was used for the documents relevant to the Shenzhen concert. Xiah Junsu, YoungWoong Jaejoong, and Micky Yoochun's representative stated on the 19th that, "We realized only recently that the signatures of the three members of DBSK were being used without authorization. The signatures on the Shenzhen concert note of confirmation were not signed by the three members themselves, but somebody else signed the paper instead."

The three members side found out about the unauthorized use of their signatures on the note of confirmation after their Korean and Chinese fans questioned the validity of the signatures. The note of confirmation in question was the document that recognized the singer's willingness to attend the concert in China. This document was then shown at the location of ticket sales in order to prove to ticket buyers that the singer would indeed be attending the concert. Sejong Law Firm's Lawyer Lim Sang Hyuk of the three DBSK members stated, "Setting aside the validity of the Shenzhen concert contract, this act was an action that brought misunderstanding to the fans. We are planning to take counteractions against this action officially."

Sejong also released a hand written document of Mr. A who says he signed the note of confirmation instead. He also showed the actual signatures of Xiah Junsu, YoungWoong Jaejoong and Micky Yoochun to show that there were clear differences in the signatures. according to the hand written document, Mr. A "Signed the Shenzhen Concert note of confirmation instead of DBSK in March." Mr. A's claims are to be investigated.

Lawyer Lim stated, "On the 19th, we requested for a judgment by an expert on the signatures on this note of confirmation and the members' original signatures. Even just by seeing it, you can tell that there is quite a big difference."

He also said, "When this lawsuit was initiated, the three members promised to perform all preassigned activities. However, the Shenzhen concert was not one of them. The members found out about the Shenzhen concert during the procedures of the lawsuit." He also said, "Even the fans knew that there was a problem with the signatures on the note of confirmation. Therefore, we asked SM to show us the details of the Shenzhen concert contract but SM did not comply."

One representative of Korean music industry, "In the case that the singer in an agency is busy, there are times when a representative signs the papers instead after telling the singer of the concert or the schedule." This representative also stated, "When the relationship between the agency and the singer is good, there are no problems . In such a case, I believe that it has become a problem due to the deteriorating relationship between SM and the three members of DBSK."

Recently, a Chinese company in Beijing filed a lawsuit against the trio and Crebeau. The three pages above contains the reasons the company sent to the trio explaining why they sued.

Here is a rough translation (certain parts are summarized to keep it comprehensible):

Regarding the use of DBSK group name or the members, Crebeau (Beijing), and the tort committed to our company:

January 6th, 2009, three members participated in Crebeau China investment orientation. Because they guys are popular, a lot of fans were present.

May 6th, 2009, Crebeau had informed our company that had invited DBSK as Crebeau product representative, the three members joined as company shareholder (director), and express that the trio will participate in a large promotion, seeing how DBSK have a huge fan base in China, with strong appeals, plus their participation in the promotion activities that Crebeau had promised, thus our company signed the contract with Crebeau.

June 8th, 2009, “Crebeau’s Korean branch WE# PLUS Co.,LTD signed contract, agreeing to become crebeau’s surety (view contract). Thus, our company invested nearly 300,000 yuan (Chinese currency) for renting room, renovating, finding staff, and other preparational work.

In June of 2009, the three of them along with Crebeau newly registered a Crebeau in Beijing. Using the name of Crebeau to contact our company and getting us to purchase more Crebeau products.

June 26th, 2009, after all the preparation work, our company signed a formal contract with Crebeau. We spent about 700,000 yuan to import Creabeau products and started the promotion.

Jun 22, 2009, as Crebeau promised and schedule, the three of them will attend July 16th, 2009 for Shanghai press conference under the title as director of Crebea, with a fan meet, allowing our company to start promoting. Our company spent 200,000 yuan on promotions.

July 8th, 2009, Crebeau (including Crebeau Beijing) have problems regarding the schedule, and informed our company that the three members will not attend the press conference and promised they will pay for all the damages, and apologized on the behave of the three members.

July 14th, 16th of 2009, The DBSK trio’s family members represented them in Beijing and Shanghai and apologized for their inability to attend.

July 11th, after DBSK’s Beijing concert, Crebeau lawyer notified us of a conference, in which Kim Junsu and Park Yoochun expressed their apologies to us.
Middle of July 2009, our company were notified of the lawsuit between Korea’s SM entertainment and the members of DBSK, and we were asked to cooperate in provide information.

July 24th, 2009, we became worried about Crebeau and the three members. We tried to contact Crebeau to ask whether they will pay us for the damages, but received no response to this day.

Regarding their actions, there have been lots of disappointment for fans, and with the lawsuit going on, Crebeau products are nearly impossible to sale, which created a large financial lose for our company, until now, our company accumulated to up to 1,200,000 yuan in loses.

Recently, we have received some information. We think there as a tort of fraud committed against us. We believe it’s not hard to see, the trio along with Crebeau’s close relations, creating a wronged believe of there was an implied warranty of authority for Crebeau, to make us enter into this. They lured our company into this, then did not attend the press conference and repeatedly apologizing, and at the same time started a lawsuit with another company, their actions created many loses for our company.

To protect us, we hope their will pay for our financial loses, or our company will take legal action, finding theirs and Crebeau’s responsibility and reveal related things.

We hope to receive a reply by November 7th 2009, or they can be prepared to face consequences.

The fans of DBSK's Xiah Junsu and Hwangbo have donated money for surgery fees and verbal remediation fees for hearing-impaired children and once again showed the warm love of fans.

According to the Snails of Love foundation, Xiah Junsu's fan community 'Xiah Soul' and Hwangbo's fan community 'Estella' showed their deep love and interest for the hearing impaired by donating money to cover fees for surgery and verbal remediation for children and teenagers.

To celebrate Xiah Junsu's birthday last year on December 15th, Xiah Soul decided that they would help a good cause rather than give their celebrity materialistic items and donated 8 million Won for the surgery and verbal remediation of Kim Dan Hee (6th Grade) to help her find her lost hearing.

On the 16th, it was revealed by Mnet's office that they have invited DBSK, whose members are in the midst of a legal dispute with their management company, to attend their year-end awards "Mnet Asian Music Award" (hereafter known as MAMA). This year's MAMA will be held on the 21st November, Seoul, Jamsil Gymnasium.

Their office said, "MAMA's aim is to show the rest of Asia Korea's culture" and "the award ceremeony will be aired across the 10 main countries in Asia, like Japan, China, Malaysia, Singapore and Thailand, where DBSK is the best artist. Thus, Korea's top artist cannot be excluded from the invitation."

On MAMA's end, they have expressed interest in inviting DBSK to attend their awards. On the 16th, they said that they would get in touch with DBSK's management to see whether it would be possible for them to attend or not. However, DBSK's company, SM Entertainment has declared that they would not be attending MAMA, so a lot of attention has been cast on DBSK to see whether or not they will attend.

An official from the KPOP industry said, "Last month, the courts approved a partial injunction to the 3 members' exclusive contract with the company, and the 3 members are allowed to participate in their own individual activities" and "while we hope that all 5 members can attend together, the possibility of only the 3 members attending is high".

MAMA is holding their award ceremony on the 21st, which was originally the date of DBSK's concert in China. However, SM Entertainment claimed that, "The 3 members expressed that they did not wish to participate in the concert that was to be held on the 21st, and the remaining performances are uncertain." TVXQ//DBSK//Tohoshinki's future in Korea is unclear. With the turmoil going on with SM Entertainment and concerts in China being canceled, the future for them in the motherland is dark and murky at best. What they need is a light and they have that in the land of the rising sun, Japan.

AVEX Entertainment, one of the top music labels and the management company of DBSK in Japan made it clear to everyone that their activities in Japan will remain unchanged.

Their representative said, "The three members want to stand on stage as soon as possible."

[NEWS] DBSK 2010 Comeback, Impossible?

Jaejoong, Junsu and Yoochun of DBSK have yet to answer to SM Entertainment on what their final decision is.

SM Entertainment revealed,

"These three DBSK members have refused to the upcoming activities as DBSK so the DBSK 3rd Asia Tour-Mirotic in China on the 21st is now canceled. The three say that they won't go to it. We regret to inform fans of this news. Because of this, DBSK's image will be damaged. Not only will this affect DBSK's Chinese promotions but it will also affect other Korean artists' promotions in China and Hallyu in general. They said to the court that they would continue with their planned activities but the concert in China that was planned in 2008, has now been turned down by them."

This press release statement continued,

"We were also planning for a comeback in Korea next year. The three members have yet to reply to us about their national comeback. Because of that, their next year comeback has become impossible. We are sorry to be announcing this."

[NEWS] What Will Become of DBSK?

SM Entertainment's proposed D-Day is now here (November 12th, 2009), but it seems the legal battle between SM and the three DBSK members, Xiah Junsu, Micky Yoochun and Youngwoong Jaejoong is going nowhere.

As of now, the three members and SM Entertainment have been unable to come to an agreement. Both parties are holding firm to their demands, but time is running out. SM Entertainment gave the three members a deadline (today), to make a decision and agree to their guidelines, however there has been no response.

Both parties have been extremely cautious with their words and have not revealed much information. When questioned about the current situation, the three members' lawyer Lim Sang Hyuk stated:

"Other than what is already known, there are no other details."

SM Entertainment stated:

"We have not yet received a response from the three members."

With both parties unwilling to budge, the situation has become increasingly grim for DBSK fans. It doesn't look like an agreement will be made today, which makes us all wonder what will become of DBSK. Stay tuned as more developments roll in.

[NEWS!] DBSK One Step Closer to the End

The three members of DBSK who have taken legal action against SM Entertainment are planning to work by themselves, according to their legal counsel.

When Sports Seoul asked the three members' legal counsel about SM Ent demanding the three members to make a decision by the 12th, they were told:

"The three members are taking a break at the moment and are planning new projects. We do not plan on responding to SM Ent's press conference. SM Ent was ordered by the court to submit relevant evidences and they have been ignoring this order for almost 3 months now and they also have not been following any other court orders. Conversations with SM Ent. will start when they start respecting the court's decision. The court said that the three members may work on their own, so we do not need SME's permission on that. We are also seriously considering making criminal accusations against SM Ent."

The three members are now planning their own projects separate from that of the five-member DBSK and in no way related to SM Ent. They also do not intend on responding to SM Ent.'s demand for an answer by the 12th.

[NEWS] DBSK's Yunho & Changmin's Fathers Speak Up

The fathers of Yunho and Changmin, the two DBSK members who were not involved with the controversial lawsuit earlier this year, spoke up in support of their sons and SME while condemning other three members and their parents. They claim that the dispute has more to do with the trouble that has arisen from the beauty product business rather than mere contractual matters.

Mr. Chung, the father of Yunho, stated:

The two members who did not involve themselves in this legal dispute are the real victims here. They suffered from financial loss, psychological suffering and most importantly they lost their reputation. Who is to compensate them for their losses? I intend to ask the other three members this: Whatever the reason, why do you intend to cause such great controversy and drive DBSK, an international brand name, into a break-up? Do you care at all about the other two members and their suffering?

The beauty product business wasn't something that was supervised by SME. On top of that, the beauty product company itself wasn't very trustworthy. When it was started, I felt that DBSK's reputation could potentially suffer from involvement with that company and advised my son of the issue. He shared my concerns as well, and that is why he did not involve himself in the business. SME later asked the three members to withdraw from the business but their parents resisted unreasonably. Mr. Shim (Changmin's father) and I tried to convince them as well but they simply refused to change their minds. I later learned that the three members took up legal actions against SME without consulting me nor Mr. Shim. DBSK is not owned by those three members only. They ignored not only the controversy that would rise but also the rights of other two members.

Mr. Shim, father of Changmin, stated:

Simply put, the other three members took legal actions against SM because of the beauty product business matter and other reasons which involve their financial gains. What they claim as their reasons, reasons such as unfair contract and unclear profit division are merely excuses to hide the true reason behind their actions. After the three members started the beauty product business, one of the parents called me and told me shenanigans like "This business can be worth millions or even billions in the future. When we tell the media that DBSK has started a business, share price of our company will hit the roof - we will tell you in advance so you can profit from the information."

Three members claim that the contract is unfair and calculations are unclear, but my son and I have read over the contract with SM clearly and agreed to all clauses, from the very first contract through all five revisions that have been made. For every income my son has received I reviewed all of the the numbers. I feel sorry for the three members and their parents as they must know of the truth but they continue to make false claims."

[NEWS] DBSK's Yunho & Changmin Supports SM Entertainment

Yunho and Changmin of DBSK//TVXQ have stated that they are on SM Entertainment's side on the legal dispute between the company and other three members.

They said that they trust SM Entertainment and will be with them in the future. The two also gave a deadline to the other members (Junsu, Yoochun, Jaejoong), expressing that DBSK will come back to promote in Korea next spring, so the other three members must make a decision before the 12th of this month.

The two members' thoughts were delivered through a document compiled by Yunho and Changmin themselves, which stated:

We five members of DBSK signed the same contract with the same clauses for the past five years, and have worked together under same conditions with utmost trust in the company, each other and our dreams. We intend to share our dream and future with the company and keep the promises we made in the contract. DBSK was made by SME and we intend to work as DBSK with SME.

No other company can create DBSK, as only SME can provide the best production and management team available. The three members should know better than anyone else that SME is the one who knows DBSK the best and made us the best. We intend to keep trust and promise and thus intend to stay. DBSK's grand future will be with SME.

We believe that our Korean promotion, planned for next spring, should be prepared at least 6 months in advance before our future as one becomes unclear. If the other three members truly want to stay as one DBSK, they must make a decision before it's too late.

They also commented on the beauty product controversy which sparked this legal dispute between the DBSK trio and SM Entertainment:

The beauty product business changed everything. We are not familiar with the matters but we believe that a legitimate company that seeks to do business with DBSK must consult with SME first. It is common sense. We did not get involved because being such a relationship without SME would have meant that trouble was ahead.

We did not want the reputation and pride of DBSK, earned by our hard work, to be ruined by a company that did not work in a legally respectable manner. We are not aware of the contract between that company and the three members, nor do we know what those members were told or how much they have earned through their deal. What we do know is that the fact that DBSK, forged together for five years by all of our dreams, has fallen into its current state because of an unethical company that is simply unacceptable.

With DBSK crumbling away like this, the current situation is unbelievable. It is sad to see that this was all caused by some beauty product company, and we hope that the three members would come back to the days when we were all working hard for our dreams.

[NEWS] DBSK Not Allowed to Continue Group Activities

SM Entertainment will hold a press conference today regarding the conflict with TVXQ//DBSK//Tohoshinki.

Lawyers of SM Entertainment said:

"The court's ruling for DBSK is not fair. They didn't consider the main reasons of the case. Their long contract is so that we can let them grow and have a long term deal with them. We want to look at their career in the long run and the court's decision is not letting us do that. This is going to affect DBSK's international promotions. It'll also create confusion for stars that want to have long term contracts and move on to bigger things later in their careers and for the companies that want to nurture talented people for a longer time. Not only that, it'll have some unwanted consequences on exports of Korean music as well as other issues."

They continued to say:

"Each year, we adjusted the contracts in favor of the members. Before this problem, the three members never complained about anything. Now that they have succeeded this much, they are complaining. They have just started to reach the top and now want to separate. Before a final decision is made, the three can do their personal and individual work. However, this does not grant the three members any rights as part of DBSK."

Because of all this, DBSK has not been able to work and SM Entertainment will seek to receive compensation for damages during the time that DBSK has been inactive.
