[NEWS] Persistant No, Dedicated Cassiopeians



Yesterday afternoon at 1:30pm KST, a couple of DBSK fans submitted a petition of a whopping 121,083 signatures to the Korean Human Right Commission in hopes to protect DBSK's human rights.“

The exclusive contract between DBSK and SM Entertainment is so unlawful and so violating of basic human rights that it is hard to believe that this is the contract between the nation’s best idol group and the nation’s best entertainment agency,” said the fans. “This contract shows the dark, sinister side of the Korean agency and is shocking the nation.”

On July 31st, Jaejoong, Yoochun and Junsu filed for the Exclusive Contract Validity Suspension and Provisional Disposition Request against SM Ent., and the offline pertition was created in very speedy 6 days from August 12th to the 18th.

The dedicated fans finally commented, “We hope that they will be able to escape from this violation of human rights as quickly as possible and we hope that the National Human Rights Commission of Korea will help us protect the rights of DBSK.”

[NEWS] Cassiopeian Shows DBSK Support on Music Bank



Last evening, most eyes were on MNet's annual 20s Choice Awards, but today, netizens are abuzz with a fan message supporting DBSK in the lawsuit controversy that aired on TV!

On last night's episode of KBS's Music Bank, fans were anticipating the return of Jewelry, excited about G-Dragon's first Heartbreaker victory and got a surprise dose of DBSK with it in the form of a placard from one of the audience members. As the Brown Eyed Girls wrapped up that night's performances with 'Abracadabra', the camera panned over the audience, lingering on an "I believe in DBSK" sign for two seconds. This has caused a great deal of talking amongst netizens.



Cassiopeians are really like no other - this is only one example of the support they've been giving their beloved group these past few weeks. As many of you know, fans collected signatures for six days (August 12-8), then submitted them in the form of an offline petition earlier on the 28th (1:30PM) to the National Human Rights Commission of Korea with a whopping count of 121,073 signatures. On the 20th, these signatures were also submitted to the Seoul District Courts. This petition expresses the fans' outrage against SME's so-called "13-year slave contract", including a claim that this exclusive contract is a violation of basic human rights and reveals the dark, corrupt side of one of Korea's top entertainment agencies.

[NEWS!] DBSK To Suspend Activities!



DBSK will be suspending their group activities pretty soon after completing all their planned schedules. This is largely due to the lawsuit filed by JaeJoong, Micky and Xiah against SM Entertainment for their slavery contract to be amended.

As spoke in the aftermath of the lawsuit, DBSK will complete their planned schedules before the lawsuit was filed which will end on 29th August. Beyond that, DBSK will be taking a "vacation", with regards to group activities, although solo activities will continue.

There are still two live performances for fans to catch DBSK together as a group before their vacation, the first being A-Nation in Osaka, Japan and their Shanghai concert.

The court has already heard both sides of the story from SM Entertainment and the DBSK trio (JaeJoong, Yoochun and Junsu) earlier. Although the court has advised both parties to sit down and settle their differences, it's kind of unlikely that a solution would be reached at this juncture. The ruling of the case will be decided on 11th September, where fans all over the world would be glued to their computers, hoping that DBSK will still exist as a group.

[INFO] DBSK's Choikang Changmin Focused on 'Paradise Meadow'

management company, TVXQ maknae Changmin still keeps a level head and focuses on his next mission - starring in a drama. "For this debut, I want to execute it perfectly," he says.

During any free time he gets, while on planes flying back and forth between Japan and Korea, Changmin is always found reading and rehearsing his script. "Truthfully, the recent crisis has began to wear on him... but since acting has been something he has wanted to do for a while, this seems to be a good motivation for him," says his assistant. [INFO] M-Flo's "Been So Long" Featuring Micky Yoochun & YoongWoong Jaejoong

For Japanese group M-Flo's 10th Anniversary Tribute Album, they gathered together a group of popular artists to commemorate 10 years of good music!

Some of the artists on the album are Marie, Mison, Simizu Shota, Beni... ok, let's get to the point--DBSK's own YoungWoong Jaejoong and Micky Yoochun have a spot on the album singing a song called "Been So Long." Even though I've only heard 49 seconds of the song, I already like it. Jaejoong's voice is just beautilful....<3

[NEWS] Crebeau Suing SM Entertainment?



According to Sharing Yoochun, the cosmetic company Crebeau is suing SM Entertainment. Crebeau is the cosmetics company in which TVXQ//DBSK//Tohoshinki members Micky Yoochun, Xiah Junsu, and YoongWoong Jaejoong are partial-investors in.

Crebeau is suing SM Ent. for libel, basically saying that SM Entertainment is making Crebeau look bad when SM Entertainment stated that the main conflict with the 3 DBSK members was over the cosmetic issue (investment into the company). When in actuality it's about the unfair distribution of income and terminating their contract.

[INFO] DBSK's 'Colors ~Melody and Harmony~' Covers Released

It was reported earlier that DBSK had sang a song called, 'Colors ~Melody and Harmony~' which will be used as the theme song for Hello Kitty's 35th anniversary.

After performing it live on July 4th during their Tokyo Dome tour, they have decided to make it into a CD and will be releasing it on September 3oth. Unlike previous single releases, this song will only be performed by Micky Yoochun and YoongWoong Jaejoong, where they both composed and wrote the song together. Amidst the legal wrangle with SM Entertainment, this is perhaps one piece of good news for TVXQ fans all around the world.

[NEWS] SM Entertainment Loses 15 Billion Won & Suffers Image Damage

SM Entertainment stated that they were the only ones who received damages because of the request for the suspension of DBSK's exclusive contract.

On the 21st at 10:20 am, the first hearing for the lawsuit between SM Entertainment and the three members of DBSK's Youngwoong Jaejoong, Micky Yoochun and Xiah Junsu, began.

During this hearing, SM's lawyer stated, "In the case of the three members of DBSK, they don't have any dissatisfied feelings towards this lawsuit as it got them out of concerts and advertisements that they did not want to participate in," and "But in the case of SM, they had to pay compensation for said canceled events and future scheduled events with 8 billion Won to pay domestically and 15 billion Won to pay if overseas activities are calculated. Not only will SM suffer monetary loss, the image of SM Ent. has also been hit because of this trial."

SM's lawyer stated that the focus of this lawsuit was not the period of the exclusive contract or the unfair income division, but the cosmetic company that the three members were involved with. He explained that the only two reasons SM Ent. asked the three members not to participate in such a venture were because such a venture went against their exclusive contract and because the venture could hit DBSK's image in a negative way.

SM's lawyer also said, "In reference to the length of their exclusive contract, the special quality of the entertainment business needs to be considered," and "Even in the recommended exclusive contract guidelines released recently, there are exceptions when it comes to singers."

He also said, "The three members claim that they never were told of exactly how much they earned but SM Ent. revealed this amount to the members every six months and the members even signed these income documents."

On a side note, the three members of DBSK filed for an Exclusive Contract Validity Suspension and Provisional Disposition Request against their agency SM Entertainment on July 31st. They also filed for a Preservation of Evidence request to be able to calculate the exact amount of DBSK's income.

The three members asked for a cancellation of their contract due to the unlawful clauses in said contract but SM Entertainment stated that the three members were filing this lawsuit because of the cosmetic company they were associated with; both sides show no signs of backing down. DBSK's leader U-Know Yunho and youngest menber Choikang Changmin did not participate in this lawsuit.

[NEWS] DBSK Forced to a Corner; Freedom at the Price of 10.6 Billion TWD?

Unsatisfied with their treatment under their managing company, members of Korean superstar boyband Dong Bang Shin Ki, namely Xiah Junsu, Youngwoong Jaejoong and Micky Yoochun have brought their case to court.

However, once the hearing is held and if the members lose their case, a compensation sum of approximately 10.6 billion TWD will have to be paid, tantamount to forcing them into a tight corner.

At the beginning of this month, news of the three members being dissatisfied with SM Entertainment and wanting to leave had begun to surface. In return, SM declared publicly that there was no such thing, and even professed that if they wanted to leave, then they would have to pay to do so.

Once the news of this got out, the 800 thousand strong fan base of Dong Bang Shin Ki almost immediately took action, firstly by using the cancellation of the SM Town Concert to start a boycott of SM products as a form of support for their idols.

SM Entertainment has also seemingly not cared much about all of these measures fans have been taking. Instead, SM has been registering the names of their popular groups such as Super Junior and So Nyeo Shi Dae (Girls’ Generation) as well as Dong Bang Shin Ki, in order to prevent Dong Bang Shin Ki from starting over elsewhere.

According to news reports, a seminar where media experts and scholars came together to discuss this problem all stood on DBSK’s side, saying that SM has used DBSK merely for profit, and the amount that they are paid every year, five miliion TWD, is ridiculous.

Now that DBSK wants their freedom back, the price that they have to pay is far too much, and purely a device to back them into a corner that they cannot retreat out of.

The “Dong Bang Shin Ki Seminar”, co-held by fans, scholars and media experts, was held in order to examine what would happen in the case if the three members lost the case: the end result would be to pay the 10.6 billion TWD compensation sum.

Thus, fans have denounced SM as a bloodsucking company, and they wish to voice out for their idols via the SM boycott!

[NEWS] Lee Minwoo Speaks Up on DBSK Issue



It seems like Cassiopeians aren't the only ones greatly affected by the TVXQ lawsuit controversy these days; KARA's Nicole has revealed her displeasure, and now Lee Minwoo of the legendary Shinwha (previously part of SM Entertainment, interestingly enough) has voiced his opinion on the matter. In a recent magazine interview, he expressed his recognition and respect for TVXQ, and that each member had deep feelings for the group; a few months ago, TVXQ had a chat with him about problems in life. "Backstage, they would hold each others' hands and pray, say good luck; the way they cheer each other on is very similar to [Shinwha]. Because they are a group which has very good team spirit, I believe in TVXQ."

The singer went on to give TVXQ a message, "My dear younger brothers, TVXQ does not just belong to TVXQ. Don't think too much and over-complicate things; just keep thinking about your fans who have spent precious times with you and who have always protected you. I hope that all of you can steadfastly protect the proud name of TVXQ. You definitely can't disband, Hyung is counting on you. After the current issue is resolved, the 11 of us should go out and have fun."

[INFO] SM Entertainment to Provide Crucial Evidence!

SM Entertainment has released a statement in regards to crucial evidence that is to be provided, for their current lawsuit with TVXQ. As many of you already know, SM Entertainment and TVXQ had their first hearing with the courts early yesterday.

At 10:20AM KST on August 21st, SM Ent. applied for an injunction in rebuttal to providing confidential documents as they should not be released to the public.

SM Entertainment said, "The process of settlement procedures, materials, and the company's trade secrets cannot be exposed to the media, as they would be fatal for the company."

The courts have however stated that the confidential information will be safe, and that they will only be reviewed by specific individuals and not released to the public.

SM Entertainment will have to submit all documents by September 11th, 2009. And with the release of these documents, DBSK's payment settlement issues may be resolved.

Meanwhile, at least 120,000 TVXQ fans have signed a petition for TVXQ's "unfair" contract and submitted to the Seoul District Court on the 20th.

[NEWS] DBSK Upset, but Hopes for the Best...

DBSK and SM Entertainment's first court hearing took place yesterday August 21st, 2009 at 11:40am KST.

DBSK's lawyer stated, "DBSK members are very upset about the entire situation, but hopes that the lawsuit will end well." In addition, "We do not want DBSK to split up. And even if they do change management companies, there is still a chance that DBSK will remain together."

SM Entertainment's lawyer stated, "There are no personal grudges against the members, however this lawsuit is an enormous loss to the company, therefore we wish to resolve this as quickly as possible and have DBSK continue their activities." In addition, SM Ent. stated that, "In regards to the members running Chinese based cosmetics businesses, SM only intervened as it could potentially hurt their image. That was the only reason."

The 1 hour and 20 minute hearing over exclusive contract rights and improper compensation is now over, however SM Entertainment is required to submit financial proof and documentation by September 11th, 2009, in order for the courts to make a final judgment.

[NEWS] DBSK Breaking Up for Good? TT.TT



DBSK's Junsu, Yoochun, and Jaejoong will have their first hearing regarding their situation with SM Entertainment on the 21st. An appeal to the courts to suspend the exclusive contract between DBSK and SM Entertainment was made (by DBSK) and if by chance the exclusive contract suspension does not go through, the 3 members will leave the group. Furthermore, it is being speculated that the two members who did not partake in the appeal, Yunho and Changmin, will walk a separate path with three new members.

Considering all this, the reactions of the fans will probably cause absolute chaos. Not only this, but people who are vying for the three open spots of DBSK will also be tearing up a storm to get a chance. DBSK's fan club Cassiopeia is currently boycotting SM Entertainment. With the cancellation of SM TOWN LIVE '09, they began the boycott on the 12th and are continuing to do so.

Of course, people are unsure of which way the wind will blow as of yet. Things with SM Ent. may be resolved, but the probability of the group breaking up is also quite real.

[INFO] Solution to 'Slave Contracts'? Is There One?

With Korean pop group DBSK embroiled in legal action against its agency, SM Entertainment, over an allegedly unfair contract, fans and agencies alike are focusing attention on the validity of so-called “slave contracts.” Contracts are dubbed as such for reported disadvantaging the stars and would-be stars who enter into them with management agencies.

These excessively binding contracts came into focus when actress Jang Ja-yeon ended her life earlier this year amid allegations that she was threatened and forced to provide sexual favors by her former agent.

DBSK brought yet another perspective to ongoing speculations regarding unfair practices carried out by both large- and mid-sized entertainment agencies here.

According to the legal document filed by three members of the group ― Micky, Xiah and Hero ― the agency prohibited their freedom as artists by claiming that the group’s and members’ activities belonged to the agency, requiring them to follow the agency’s demands to appear at certain performances and broadcasts, and requiring them to stay under the agency’s wing for 13 years.

Experts say that this type of contract is standard in Korea’s entertainment industry. A newcomer’s path to stardom depends highly on local agencies’ investments, unlike in the United States, where up-and-coming artists often sign deals with agencies after proving their talents at bars and small theaters on their own.

“From top stars like the late actress Choi Jin-shil and singer Uhm Jung-hwa, celebrities were ‘made’ into stars by their agents and agencies. These young artists need to be ‘invested in’ for at least 10 years,” said Choi Jung-han, a lawyer and former head of the Korea Entertainment Law Society.

The agencies, naturally, extend contracts for more than 10 years to collect investments in the future. Of course, this only applies to successful cases.

Choi explained that although agencies spend their time and money investing in several groups and aspiring talents, only a few of those clients ever taste success. This leads to contracts that trap successful stars into what is now referred to a “slave contract.”

“If the case with DBSK and SM does not settle down in a proper way, the same incidents will continue again and again. We must revise contract terms regarding the contract periods and profit distribution,” Kim Won-chan, chairman of the Korea Singers Association, said during a radio interview last week.

Kim pointed out that although SM Entertainment claimed that they offered 11 billion won to the members, the fairness of the payment amount should be questioned, considering the overall profit the agency has received over the past years.
“There must be separate regulations detailing the maximum and minimum amounts in profit distribution,” he said.

The Fair Trade Commission posted a recommendation notice regarding the issue last month, setting forth a standard contract for artists and agencies.

“The commission did release the notice as a standard contract, but this does not have any legal effect, which is why many agencies and artists are quarreling about the actual practice of it,” culture critic Kim Sung-soo said.

Kim added that the overall atmosphere must change to scrap such “slave contracts” and messy legal disputes.

“This type of discontent appears because Korea focuses on only a number of stars. Agencies have no choice but to rely on those who are popular and successful. In the case of major entertainment agencies, newcomers have no choice to follow their contracts to become famous. We have to change the overall system so that the entertainment business can focus on a larger and longer perspective and nourish various types of artists,” he said.

Meanwhile, the group is expected to follow through with their scheduled performances in Japan. Avex, the group’s agency in Japan, said last week on its official Web site, “We will support DBSK’s Japan activities to the full. We expect fans to continue to root for DBSK,” according to Yonhap News.

“We have received assurances that both sides don’t want the group to disband. This is interpreted as meaning that SM and the three DBSK members will go ahead with their scheduled performances in Japan,” Avex said.

The K-pop group will sing in Tokyo on Aug. 22 and 23 and Osaka on Aug. 29 and 30.

The five-member boy band will also appear on “Music Japan,” NHK’s music program* next month.

[NEWS] (o8o5o9) SM Ent. Applies for Trademark Rights on 'DBSK'

SM Entertainment has once again applied for the trademark rights for Dong Bang Shin Ki.

It is known that SM Entertainment had gone to apply for continuation of trademark rights for the name ‘Dong Bang Shin Ki’ at the Korea Industrial Property Rights Information Service (KIPRIS) on 5th August together with 3 other names.

Currently the company is in a lawsuit with Dong Bang Shin Ki 3 members Xiah Junsu, Micky Yoochun and Hero Jaejoong, and this application has brought up different interpretations from music experts.

With the case of SM Entertainment applying for trademark rights for the name, especially since there was once in 2004 SM has refused to do so for 東方神起, much interests are roused as to the intention behind the act.

SM Entertainment also applied for trademark rights of other groups like Super Junior and So Nyeo Shi Dae on August 4th.

One music industry expert said, “Applying for the trademark rights for the singers in your own company is a natural thing. Sometimes it has been taken as a sensitive issue by many.”

Another said, “The company has the right and this is a natural thing to do. It shouldn’t be seen as a bad intention.” While another said, “Dong Bang Shin Ki is a group that is wellknown throughout Asia and Korea. If the trademark rights are abused, it is damaging to their image. There was a problem of disbanding some time back. But it is true that the sensitive time comes when the company applies for trademark rights to the name.”

To me, SM is just scared and they want to claim the names just in case they lose so the guys can't use 'Dong Ban Shin Ki' anymore. I really hate the fact that they're so greedy with things like that. Singer/actress Eugene talks about her views regard the discord between SM Entertainment and Dong Bang Shin Ki. She said in a recent interview, “Even though I don’t know the details, I hope both sides can settle this amiably.”

Eugene was from S.E.S under SM Entertainment debuting in 1997. S.E.S was one of the first girlgroups and had the concept of fairies and had made issues with their songs and costumes. After which, there were the other girlgroups like Fin.K.L, Baby VOX, Chakra. And then recently we have WonderGirls and So Nyeo Shi Dae etc.

Eugene said, “It is true that SM have a good training system for a big company. With that, there are many youths who wants to debut under these big companies and there are many cases of them signing long term exclusive contracts with the company. [NEWS] DBSK's Homepage Flooded with Complaints

After the ‘SM TWON LIVE ‘09′ was postponed indefinitely by SM Entertainment who said the reason was the lawsuit between the agency and DBSK’s three members, Xiah Junsu, Micky Yoochun and YoungWoong Jaejoong, the fans’ criticisim has been flooding in.

SM released an official statement on the 7th of Augus stating that, “The ‘SM TOWN LIVE ‘09′ that was scheduled to be held on August 16th at the Seoul Jamsil Olympic Stadium has been postponed indefinitely.”

SM also stated that all ticket holders would be receiving a full refund but the fans’ rage did not subside easily. On DBSK’s Hompage, posts of disappointment came from not only DBSK fans, but from fans of other singers who were to be performing in the SM TOWN concert.

DBSK fans stated, “We put a lot of effort and money into making events, and now they’ve become obsolete,” “How are they going to compensate for our efforts to secure tickets?” “We even rented a car to go, how are going to compensate for that?” “We’ve waited one year, and this is what we get?” They showed such strong reactions and protested to SM Entertainment. Some fans said that SM was trying to place the blame on DBSK by saying that the concert was postponed because of the group and harshly criticized SM for what they did.

The fans of fellow SM Entertainment singers such as SHINee and Super Junior also showed their discontent and sided with and supported the fans of DBSK.

Some fans said they would visit SM to give their complaints while other said they would boycott SM goods. There has also been a suggestion for all the fans to gather and rally against SM on the 16th at the Jamsil Olympic Stadium at the time the concert was supposed to happen.

SM said, “SM TOWN LIVE ‘09 was a concert that was extremely popular with tickets being sold out as soon as they were put on sale, so we are very sorry to be giving out this unfortunate news,” and “We promise to bring a better SM TOWN LIVE concert in the future to those fans and families who wish to come to these concerts.”

[NEWS] DBSK Gets 'VIP Treatment' in Japan

TVXQ participated in the Meiji Jingu Fireworks Summer Event held in Tokyo, Shinjuku. The staff working at the event covered the passage that lead the members to the stage with black material so the members would not feel disorientated by the fireworks.

According to Japan’s Daily Sports newspaper, “So that the five members, including Junsu(23), Jejung(23), and Yuchun(23) who filed a lawsuit against SM, would not feel disoriented or panicked by everything, the staff at the event covered the passage leading to the stage with black material and gave the members ‘VIP Treatment’.” It also said, “After all five of them said, ‘Hello, We are TVXQ!’ in unison, they sang seven songs straight without wavering.”

[NEWS] DBSK Angered by Influence of Slander



"Don't mention any troubles between the members."
Misunderstanding due to their mysterious close acquaintances.

DBSK members are angered by false truths being reported and the influence this has caused.

On the 6th, the lawyer representing the three members stated, "there have a rampage of statements given by people who were reported to be close acquaintances. The speculative and slanderous reports by them are distorting this situation. They have appeared and discussed issues such as motives for the lawsuit but they all possess some misunderstandings about the issue. Acquaintances are only acquaintances, they are not DBSK members. There is no troubles between the members. Members are not happy about what they are hearing.

Through their lawyer, the three members recently forbid all their close acquaintances from talking about this issue. Not only did all members change their contact information, they have expressed their intentions not to publicly speak about their official stance for a while. This can be seen as decisions due to the troubles that slips of tongues has caused.

The reason that DBSK members have forbid their acquaintances from talking is due to the start of rumors about troubles between the members. They have expressed multiple times that there are no troubles. However, a close friend of the members revealed that there was some trouble between the members who filed for lawsuit and the 2 members who did not. There was also rumors that after the Thailand concert, the members hunt out separately and that they acted separately even in Korea. These rumors were found to be groundless. DBSK members left to Japan on the 6th and as always, arrived to the airport in one van.

The same thing can be said for rumors that the 3 members filed for lawsuit without consulting the other two members. This time, a 'close acquaintance' of the two members showed up stating that the makeup company was the reason for this lawsuit and that the 2 remaining members remained silent in order to avoid disbandment. This acquaintance reported that if the situation worsened, the two members would file for compensations to SM and the three members.

These rumors cannot be confirmed, and moreover can make the situation worse. The lawyer and SM both revealed that these rumors are false. A staff reported, "the situation is very sensitive. The situation changes by the minute. The act by the members to forbid their close friends from talking was unavoidable."

[NEWS] SM Entertainment Speaks Up



SM Ent. recently made an announcement that the boys are actually getting 4:6 (40% DBSK / 60% SM Ent.) of the profits. During the last 5 years, DBSK has earned about 49.8 billion won which is equal to a bit more than 40 million USD. From this amount, 22.4 billion won (a bit more than 18 million USD) was subtracted for the expenses SME invested in the group. From the remaining 27.4 billion won (a bit more than 22 million USD), the profits were divided 4:6.

SM Ent. stated "Right now the profits are split DBSK 40%, SM 60%. From the 27.4 billion won, 10.1 billion won (almost 9 million USD) goes to DBSK and 16.4 billion won (a bit more than 13 million USD) goes to SM Ent." Furthermore, it was mentioned that for overseas activities, DBSK earned 70% of the profits while SM Ent. made 30%. This included all events, festivities, and commercials.

"The calculations of the profits are too vague. We cannot trust it."

[NEWS] KARA's Nicole doesn't want DBSK to Disband!



Nicole, member of group KARA, who are currently busy promoting their second full length album Revolution, expressed how she felt about the news regarding DBSK.

While in the waiting room for KBS2TV's Music Bank where KARA had a special stage with Brown Eyed Girls, Nicole was asked by reporters about her thoughts on the on-going trouble in SM Entertainment regarding the case filed by the 3 members of DBSK against the management.

Nicole expressed outright that she did not want the group to disband.

She says "I'm really sad about the rumors regarding the disbanding of DBSK. As a fan that really likes DBSK, I hope that this problem can be solved amicably. [NEWS!!] Dong Bang Shin Ki possibly leaving SM Entertainment?

The future of idol group DBSK is uncertain. DBSK's 3 members (Micky YooChun, Xiah Junsu, Youngwoong Jaejoong) and SM's trouble is too deep. Although they state that there will be no disbandment, in reality, disbandment is more than likely. Even if they avoid the worst case scenario, disbandment, it feels like their departure of SM is set.

On the third, a acquaintance of the 3 members said, "settlement with SM has been tried multiple times. But their differences couldn't be settled. The reason this went to court is because they couldn't find a point to settle." Thus, they concluded that more attempts for negotiations was useless.

The acquaintance that the reporter met is someone who has watched over DBSK very closely. He has experienced all ups and downs since debut until now. According to him, DBSK advocated for only one thing. They wanted conditions of the contract to be eased. However, it has gotten to a point where the conversations between the two parties have gone nowhere.

He stated, "they asked for the contract term and earnings distribution to be revised because everyone could tell it was irrational. They attempted to negotiate until the end but they felt that SM was avoiding them. Therefore, things got emotional for both parties and the 3 members are even more angry with SM's response."

After the initial reports about this incident, SM sent documents on the 1st and the 3rd. On the first, they reported that this problem was due to the makeup company investment and they will work it out. After the contract conditions were reported, they responded that members were paid 11 billion Won and were given foreign cars as presents.

In response to this, he stated, "the nature of this instance is the unfair contract, not the make up company. However, SM has not mentioned the contract conditions and have continued to use make up company issues to play with the media."

He also criticized abnormal methods of calculating methods. According to him, "SM requested money for back dancers and food. Basically, almost all of the expenses were paid for by DBSK." He added, "besides this, SM created a local subsidiary and divided the earnings of DBSK into pieces. For example, SM Japan and Avex divided earnings, and this was also divided with Korean SM. With complex divisions, the money for the members were reduced.

Also, he stated that the foreign cars were given to them under the company's name. "They received cars from SM after an award ceremony. However, the cars were registered in SM's name and is not owned by DBSK."

"The three members are as tired as they can get."

According to this acquaintance, the three members of DBSK are tired of SM's play with the press. They have no intention to solve this with mere words, and are extremely upset that SM is exaggerating only one side of the story, distorting the truth. He said, "they expected SM to twist words with the press but didn't realize it would be to this extent. If SM continues this method, I think it would be nearly impossible to work together with SM again. I suspect that they will part with SM and try to find a different solution to settle this.

Their departure from SM does not bean the disbandment of DBSK. He asserts that there is no problems in relationships between all the members. But in the process of negotiations, there was differences between the members. That is why only 3 members decided to fight with their company. [NEWS!] SM Entertainment Refutes DBSK's Claims! Stock Dropping.

SM Entertainment refuted DBSK's claims and stated that since their debut up until this month (July 2009), DBSK has earned more than 11 billion won (over $9,000,000). They stated that despite the huge losses and budget problems that SM Entertainment has had these past years, the boys were paid royally (around $1,800,000 each) and that they also received high end products as gifts (cars, music players, LCD TV's, etc.) SM Entertainment stated that the $9,000,000 earned doesn't include the money that DBSK received from Endorsements/CF's, Events, Photo Ops, Signings, Japan sales, etc. SM Entertainment also stated that there is no law stating that a contract for an artist cannot be sign for more than 7 years. They concluded saying that they will try to resolve these issues immediately.

Seems as though LSM is trying to make him look like the victim here. Too bad for him. All this negative attention is causing the company's stock to drop. It fell down around 10% already. Here's info according to Forbes:

[NEWS] DBSK's Official Statements Regarding Dispute!



As almost everyone knows by now, popular boy group DBSK//TVXQ members, Youngwoong Jaejoong, Micky Yoochun, and Xiah Junsu have been disputing with their company, SM Entertainment. The members finally released their official statements, which had thousands waiting for what the members had to say. (Including me! OMFG.)



Their lawyer stated on behalf of the three boys, "During the five years after they debuted, the company has done whatever they wanted which made the body and spirit of the members of DBSK very tired. The 13 year exclusive contract is too long that, which to them, feels like a life long contract. The members don't receive what they deserve."

Because of the carelessness of the company, Korea's No.1 boys have been suffering from both mental and physical fatigue and feel that they are just being used for profit for the company. (Oh, no really. This was quite obvious from the start. T__T) Not only are there standards that have to be met in order to be paid at all, the boys also receive only a few hours of sleep a day, which is nothing close to what just one day in their schedule needs! Additionally, the 13 year long contract, which excludes the time they will be completing their military activities, will exceed over a mind boggling 15 years.... and it hasn't even been close to 13 years yet! Although the boys have considered it, cancelling the contract is also out of the question, as there is a huge price to pay - approximately a several billion South Korea won (KRW).

The lawyer expressed, "The members don't want to disband, but they just feel that the contract is ridiculous. Right now, the things each of the three members want is a little different, however, the relationship between the members is still unaffected, as they still want to be one." (Oh course! DBSK's bond is too strong to be affected. <3)

DBSK's reasons:

1. During the five years after debut, the members were forced to follow a strict and tight schedule according to their company which made them very tired.

2. The 13 year exclusive contract is basically a lifetime contract.

3. The members aren't getting what they deserve from SM.

4. Multiple times had the members suggested that their contract be revised, but the company did not listen to the members' opinions.

5. The outcome of their cosmetics shop has nothing to do with their singing career.

6. The members have never wanted the disbandment of their group. The issue just spurred from the boys wanting some freedom from the contract.

[INFO] DBSK Disbandment Issue Summary & Clarifications



With all the response and confusion that allkpop & cassiopeialuv has been getting about this whole DBSK issue, I hope that this comprehensive list will clear up any miscommunications that may have arisen from information posted previously.

First Off, The Facts:

1. Jaejoong, Yoochun, and Junsu filed a lawsuit against SM Entertainment in order to suspend their contracts.

2. Jaejoong, Yoochun, and Junsu did plan to manage a branch of a cosmetics company. This did NOT however relate nor tie into the lawsuit.

3. Yunho and Changmin are NOT filing a lawsuit against SM along with their fellow three members.

4. SM has been taking anywhere from 70-90% of DBSK's profits.

5. DBSK is also signed with AVEX Entertainment (Japanese entertainment label) and are still scheduled for A-Nation concerts throughout August.

6. There have been NO talks of disbandment. (Thank GOD.)

Addressing the facts: (these go along with the numbers above)

1. The lawsuit suspends the three members' contracts while pending. Popular belief is that they want to renegotiate parts of their contracts, POSSIBLY because of SM's disapproval of fact number two.

2. This is a fact, enough said. SM released a statement that "The cosmetics company issue will be resolved", but that statement did not refer to the injunction filed by Jaejoong, Yoochun, and Junsu.

3. They are not, and this is why rumors of a breakup started flying because of this inconsistency within the members. It is just a coincidence that the two are not involved with the cosmetics company are also not filing a lawsuit against SM.

4. Yes but, to an extent, this is not as extreme as many people think. SM does take an unheard of amount from DBSK, but they also pay for anything and everything the members need. This includes plane tickets, hotel suites, meals, car rentals, etc. This effectively makes it so that DBSK members do not have to spend a penny while under contract, but it does bind them to SM and prevents them from doing anything that would require large amounts of money (such as splitting from the SM label) without approval from SM. This has not affected the lawsuit at all, as neither DBSK nor SM has said anything regarding the issue of pay.

5. This fact proves that SM cannot just disband DBSK without legal repercussions. If SM were to disband DBSK, AVEX would also lose a lot of money on the situation and would obviously sue. They also performed without incident today (August 1st) for A-Nation.

6. Nowhere has there been a statement about disbandment or splitting. DBSK members and SM have not said anything regarding the issue. Mentions of Disbandment are just assumptions by the media and fans at large because of the lawsuit.

Now, For the Rumors:

1. There has been fighting among the members which has caused talks of disbandment.
(Okay, who started this one? Ridiculous.)

2. Junsu's father was at the head of the preparations to sue SMEnt. when SM caught word of the pending lawsuit and proceeded to bully around Junsu. (I never even heard this one! O_O)

3. DBSK members responded on their Cyworld mini hompages with messages suggesting that disbandment was highly unlikely. (I don't think they have the time...)

4. DBSK is under the same situation as their predecessors, H.O.T. and Shinhwa (maybe even S.E.S.). (Hello, me? Was starting to believe this one. >_<)

5. TVXQ is in this for the money. (Really. What kinda...no. False rumor.)

Regarding the rumors:

1. No, there has not been ANY fighting among DBSK members and that was highly unbelievable in the first place.

2. This still just a rumor and nothing has been confirmed, but many Korean bloggers have caught a hold of this specific issue and have been discussing, so there is still some validity.

3. Yes, this has been proven to be false. Contrary to popular belief however, allkpop & cassiopeialuv never confirmed this was true and even stated that the pictures were most likely fake. We are trying to keep readers up to date with anything and everything that may arise about this situation. With hot issues like these, getting news up quickly is our first priority and when things are disproven, we will take measures to address the situation. 4. Although the whole situation may remind some people of what happened with H.O.T and Shinhwa, the circumstances are very different. Many people have many different opinions on this, but the situations are not parallel.

5. The insane split of profits with SM may have something to do with the pending lawsuit, but more than likely not. The 10-30% that DBSK receives in profits is still more than the average upperclass American citizen makes in 10 years. More than likely, money has no part to play in this lawsuit.

6. Rumors have been going around that the two of them decided to stay with SM but this is confirmed to be NOT TRUE according to the official DBSK fansite.

And Lastly, Speculations: (NOTE: these are all predictions and outcomes that have been expressed by both the non-Korean AND Korean parties.)

1. DBSK will leave the SM label and continue their promotions under a different or possibly independent label.

2. DBSK will break up and SM will lose lots of money, possibly leading to a shutdown of the company.

Response to Speculations:

1. At the moment, this is the most popular outcome that most people agree upon. They believe that DBSK will win this lawsuit, leave SM and start an independent label or sign with another big label such as JYP or YG. In my opinion, this is unlikely. The lawsuit has nothing to do with terminating DBSK's contract with SM. Along with that, SM has a lot of influence over MBC, KBS, and SBS and can easily prevent them from performing on any of their music shows and cause many hardships for the guys. This is what happened to Shinhwa. On the other hand, DBSK is arguably THE hottest band in K-pop and promotions aren't necessarily needed in order to sell albums.

2. In my opinion, this is highly unlikely unless SM plays a part in breaking them up. There is no proof that any of the members have been fighting. This is probably just an outcome that anti-fans have come up with to dishearten others. But please remember, the possibility is not ruled out and everything is up in the air until official statements from both parties are released.

Or could this be the work of desperate fans and photoshop? We haven't been able to confirm this on UFO, so we're leaning towards the photoshop. (Most likely false.)

The past 24 hours have been crazy and restless for Cassiopeia, I am included, as breakup rumors have flooded the internet. Alleged responses from "Jaejoong" and "Changmin" regarding the rumors were supposedly found and screen-shotted from the UFO portal, where k-pop stars often respond to fan questions and comments.

The members all performed with no issues at A-Nation in Japan earlier today. The rumors might not be true after all, so Cassiopeia, don't freak out too much just yet.

[NEWS] Experts say: "Very Difficult for DBSK to remain One"!



A bad day for fans of the most popular idol group in Korea, Asia and the world. The day started off with rumors of TVXQ//DBSK disbanding, which was followed swiftly by SM Entertainment representatives stating, that they will pretty much do whatever it takes to keep DBSK together.

This major conflict resulted in Lee Soo Man, owner of SM Entertainment, to fly back home to Korea from his America headquarters, to try and resolve the matter personally. At this time however, there are still no new developments about the progress of the negotiations. There's only speculation and rumors of what's to come.

A Music Industry Expert stated, "Usually when an issue like this arises, it's very difficult to come to a resolution. Currently the 5 members of TVXQ are split into two teams. In addition, the animosity that has come about between SM Entertainment and TVXQ, will make it very difficult for all 5 members of TVXQ to remain together."
