[INFO] 'MIROTIC' Lawsuit & Article on Restriction
SM Entertainment to repeal order ruling ‘MIROTIC’ harmful media for teenagers.
Dong Bang Shin Ki’s 4th album title 'MIROTIC' was ruled as unhealthy media content for teenagers by the Commission of Youth Protection recently. With that, SM Entertainment has filed for repeal on that on 16th December at the Seoul Administrative Court.
SM said, "The reason for ruling the song as unhealthy was that part of the lyrics have inappropriate expressions. But exactly which expressions are not appropriate it was not made clearly so. But the fact is that the lyrics only point to things like love and kiss etc. Nothing lewd was mentioned or depicted in the song."
"Also the lyrics 'I've got you' etc are just corresponding expression we put in, hence there is the possibility that people misunderstand the song. When you look at them rationally, it is like how one’s charm and confidence to love, something that teenagers will relate much with this days."
SM also voiced, "We understand that the measurement and punishment to the ruling of inappropriate media for teenagers should be strict. But it is also illegal to rule something as harmful and inappropriate for teenagers when it does not exactly contain sexual or unhealthy content."
SM has also appealed for suspension of administrative order by the Commission of Youth Protection to produce a clean version of 'MIROTIC'.

= = = = = = = = = = =
So the law suit is still going forth at this point in time. Not cancelling/withdrawing, that was just a misunderstanding from one blog writer, who used that misunderstanding to write up an article. And unfortunately news in this fandom spreads pretty quickly. Allkpop already has their version up.
On the topic of the MIROTIC-restriction, here's an recent article written by a Korean newspaper (English edition) on the subject:
Teen tunes get the rap from censoring body.
Recent albums by pop stars like Dong Bang Shin Gi and Rain have recently been rated "harmful for teenagers." Korean authorities have been rating Korean pop songs since 1999, but this marks a rare case when they rated major hit songs as potentially harmful.
By Kim Hyung-eun
Christmas shoppers were busy browsing through the CD and DVD section at Kyobo Book Center in Gwanghwamun, central Seoul, one recent weekday, hunting for the latest albums by their favorite artists.
But among the classical and Korean pop music shelves, one section was remarkably less active.
In fact, there was just a lone, middle-aged man looking through the season's offerings.
Other buyers were put off by the sign in big, red tape: "Cannot Be Purchased by Those Under 19."
Korean record shops have had this special section since 1997, in accordance with the Youth Protection Law.
Korean authorities categorize albums that contain songs with what they consider sensational or lewd material as albums that shouldn't be sold to people under 19.
Record companies are obliged to attach special labels, and record shops have to set up a separate area for those records.
But there was a rare sighting this time. At the top of the shelf were the latest albums by two major artists in Korea, possibly two of the most famous and successful pop singers in the country: Dong Bang Shin Gi, a boy band also known as TVXQ, and Rain.
TVXQ's fourth album, "Mirotic," has sold more than 482,000 copies as of Nov. 30 since its release in September, making it the best-selling album since Seo Tai-ji put out his seventh album in 2004.
Not only that, TVXQ won the Grand Award, one of the most prestigious awards in Korea's pop industry, at the Golden Disk Awards last Wednesday.
Rain, an award-winning singer-cum-actor, released his fifth album, "Rainism," in October, two years after his previous album. His return to the local pop scene made headlines, as he has focused on his career abroad for the last couple of years. He was in the Hollywood movie "Speed Racer" this year.
Just last month, the Commission on Youth Protection, under the Ministry for Health, Welfare and Family Affairs, categorized TVXQ's Mirotic and Rain's Rainism as "harmful material for youths," along with 108 other recent songs.
Since its launch in November 2006, the commission has passed the same verdict on 926 Korean songs, 529 so far this year, which is 50 percent more than last year.
The Korea Media Rating Board began to rate songs in 1999 in line with the revised Youth Protection Law. The job was transferred to the Commission on Youth Protection in 2006.
The songs categorized as harmful materials for young people cannot be broadcast before 10 p.m. If they are not labeled according to the law, the record producers or music shop owners face fines or even imprisonment.
But in the decade since the rating system was put into operation, top acts have not been affected.
In Rainism, the lyrics that troubled the commission's radar were "my magic stick that is rolling in your trembling body." The members of the commission reckon the "magic stick" symbolizes a penis.
Others dismiss such an idea.
"Rain was working on his dances using a stick and that is how the phrase 'magic stick' came out," Rain's management company J.Tune Entertainment is quoted as saying. "It wasn’t the writer's intention to imply anything provocative, but the commission has taken the lyrics on its individual discretion."
But J.Tune Entertainment decided to accept the commission's ruling and released a "clean version" of Rainism with revised lyrics.
As for Mirotic, the commission said the general mood of the song is highly suggestive and could have a negative impact on teenagers.
But such an inarticulate explanation has both TVXQ's producers and, of course, the fans furious.
"We will make a clean version in accordance with the commission’s administrative order, but since we cannot fully accept the ruling, we plan to make a provisional disposition with the relevant court to nullify the administrative order," said an official with SM Entertainment, TVXQ's management company.
[Side comment - See source article]
The Commission on Youth Protection accuses "Mirotic," the latest song by Dong Bang Shin Gi, of being sexually provocative and implying rape. Dong Bang Shin Gi fans, however, have denounced the commission's claim. [JoongAng Ilbo]
[Continuation of the article]
If SM Entertainment makes the provisional disposition, it would mark the first time the music producer has filed a claim against the authorities' rating decision.
Meanwhile, TVXQ performed the clean version of the song at the Golden Disk Awards last week. Lyrics such as "I got you" were changed to "I chose you" and "I got you under my skin" to "I got you under my sky."
Immediately after the commission's decision came out, TVXQ fans put up angry postings on the message board of the commission's Web site (http://www.youth.go.kr). It's been more than two weeks since the ruling was announced and a week after it came into effect, but the fans are still leaving such messages.
"You guys say you're working for us, but how come you’re forbidding us the songs and singers we love," Seo Han-ol wrote on the board.
"When we listened to the song, we didn't have the 'weird thoughts' you had. I guess different people hear it differently, but few people hear it the way you did," Kim Haeng-seon, another Web user, wrote.
At Agora, a major online discussion forum run by Daum, more than 15,959 people have signed a petition against the commission's decision.
The latest incidence has triggered heated debate over the measuring stick used for rating music. Critics point to the effectiveness of the rating as it comes out weeks, even months, after the release dates of the albums.
"TVXQ's album has sold more than 400,000 copies already. Plus, they've performed on TV many times. What's the point of the rating at this point?" an official with a record company said, refusing to be named.
In response, the commission says its bigger goal is to red flag sensational media in general.
"There are three rounds of deliberation in total. It takes at least 26 days for the rating to take effect," said an official with the commission. "We went ahead with our screening, hoping to present a social standard that can put a break on provocative materials."
But reining in the spread of the song's original versions online remains a challenge. The commission has ordered portal site operators to see if the songs rated as over-19 only are properly labeled and kept from teenagers. But one can still find their songs and music videos of the "unclean" version in the blogosphere.
The commission says it entrusts the job of online control to portal site operators. But controlling files that are posted on a real-time basis isn't an easy task for the operators.
The limited number of rating authorities is another problem. While about 30,000 new songs come out every year, there are just 11 members in the commission, excluding several other monitoring officials and outside experts.
Opponents of the commission's rating decision also underscore the issue of freedom of expression and creativity.
"This ruling will limit the artistic freedom of music producers," said Seong Wu-jin, a music critic. "It's like pre-release censorship has been reborn."
This system was in place from the 1960s to 1990s when more than 380 Korean songs were banned for reasons like "alarming ideology," "demoralization" and "Japan-oriented."
In 1996, the song "Sidaeyugam," loosely translated as "Regrets of the Times," by Seo Taiji and Boys, a popular boy band in the 1990s led by Seo Tai-ji, was also banned. The incident led to mounting public criticism and eventually to the demise of the pre-release censorship policy.
"Since the kind of harm they talk about is so subjective, they must present realistic standards," said Kim Jak-ga, a pop music critic.
Concern about provocative material in the mass media has alerted some conservative parents. In the latest incident, singers Lee Hyori and T.O.P. kissed during their performance, triggering a heated debate online. The kiss was pre-meditated, their management companies said.
Despite the ongoing controversy, the Commission on Youth Protection will have another round of talks this Thursday on some 80 new songs. If the members decide to rate some of them as harmful material for youths, another batch of CDs will soon find a new home on the red-taped shelves.

[NEWS] SM Entertainment Fights Back! & Japanese Coverage on the banning of "주문 - MIROTIC"
SM ENTERTAINMENT LEGAL COURT CASE AGAINST THE BANNING OF DBSK'S 4TH ALBUM FOR UNDER 19 .
Previously, we reported on how DBSK's 4th album was put under the 19 year age banned by the Youth Safety Association on November, however SM Ent. will starting next week file a legal case against this to the Justice Court/District Court.
DBSK's Management SM Entertainment (SM), quoted by Money Today's Star New : "We will go through administrative measures against the suspension by filing a case next week to the District Court". "We have been getting ready for this legal case on the 2nd."
"We have agreed to release a clean version of 'Jumon - MIROTIC' by the administrative order, but this is something we do not agree with and feel this is entirely unfair. Therefore we have decided to file a case to the court against the administration's displosure."
Ministry for Health, Welfare and Family Affairs administration has on the November 27th declared that DBSK's rth album's MIROTIC's lyrics were provocative and put the album under harmful to the Youth.
The Commission of Youth Protection have said that the words and the meaning of 'Jumon-MIROTIC' were not the only problem but the entire lyrics' meaning was harmful and overly sexual.
After the Commission of Youth Protection had released this statement SM. Ent said, "Even before when the order had been put against MIROTIC, we have clearly negotiated and tried to explain the real meaning and explanation of the lyrics , but even after this the results came out unexpectedly and we are bewildered as of this moment", "and the JUMON -MIROTIC's lyrical meaning is entirely different and miles away from the erotic or sexual that the association is making it to be."
DBSK's 4th album, by the END of November, hit 460,000 sales (Fon SM. Ent). This is the highest record sale for this year out of any artists/idols.
However with the current condition and news coverage of DBSK's CD age ban has caused Japanese Media to release news coverage of this.
On the 4th, Japan's AsahiTv, Nihon Tv. etc. had released their coverage as 'Asia's Star DBSK and the ban of the CD release single MIROTIC.' Sankei Sports news on the 5th, Sports-Nippon released their news "AGE ban of DBSK 4th album,, will this AFFECT DBSK's attendance for NHK's Red & White Ceremony?" (the PD For NHK already released a statement that said this incident will not prevent DBSK's attendance.)
DBSK have also hit the top charts in Japan's Oricon charts numerous times, and have won twice in a row the golden artists award at the " Best hit Gayo Awards" Japan.

[NEWS] DBSK Faces Dilemma; May Not Attend the 3 Year-End Korean Awards
Will Dong Bang Shin Gi be able to participate in the year-end awards in Korea?
This year Dong Bang Shin Gi released their 4th album ‘MIROTIC’ in September with 500, 000 in album sales proving their influence as Korea’s top idol group however their participation in the year-end ceremonies will be affected due to activities in Japan.
On the 4th, Dong Bang Shin Gi’s label, SM Entertainment told Newsen that the group “will have to leave to participate in a Japanese broadcast on the 30th to the 31st” and that they’re “currently discussing a plan for activities in Korea.”
Like every year, Korea’s top 3 year end music festivals are planned to be held 29th for SBS, 30th for KBS and MBC on the 31st. The celebrations held on the 30th and 31st are proving to be a difficult situation.
The reason that attendance at the year-end festivals is proving to be difficult is because Japan is calling the boys back. Dong Bang Shin Gi is among the list of attendees at the biggest event in Japan’s music industry, the NHK Red & White Year-End Festival. The event will hold a significant meaning to the group since it’ll be their first time attending.
Dong Bang Shin Gi will also be attending the Japan Record Awards on the 30th as prize winners.

According to information provided by SM until 11-30, online sales had reached 163,346 copies, while offline sales had reached 303,468 copies, making total sales 466,814 copies.
This year's highest record sales by DBSK is one that no one can catch up to, proving once again their power continued from 2006, when they took the highest CD sale records for the second time.
The 300,000 copies of their fourth album pre-orders were not just from Korea, but also from Japan, Taiwan, Thailand, and other such Asian countries, taking over CD sales charts and showing their power. DBSK said, "Receiving everyone's love after coming back with another album in 1 year and 7 months is something we're really happy for. Right now we want to thank everyone who's supported us."

Asia Song Festival - Seoul, Korea

Ok, so does anyone remember the "boy band" days? Nsync, Backstreet Boys, New Kids On The Block, or any other group with three or more members, singing and busting out choreographed dance moves? Well, in the United States, the "boy band" era, for the most part, has faded away. But in Korea--it is as strong as ever! I couldn’t BELIEVE how HYSTERICAL people were for Korean Pop (a.k.a "K-Pop"). I spent a whole day surrounded by thousands of screaming teenage girls. I loved how excited they were to see their favorite K-Pop singers, but I think I lost most of my hearing by the end of the day. Lol. Just kiddin.
{DBSK is here to stay with all their support. Die haters, Die.}
The thing that surprised me the most about some of the "adoring", "sweet", and "innocent" teenage girls was the things they SAID they would do to their pop star if they could get the chance! Lol. I was thinking "Girl! You are like, 15! How do YOU know what THAT is--or how to do that -- where the HECK is your mother!" Lol. I guess I underestimated the Korean youth.
{hey, we know things ^^}
While at the festival, I learned about all kinds of FAMOUS K-Pop bands like: Girls Generations, Shinee and a whole bunch more! But, the ONE band that I heard about every single second of the day was TVXQ, also known as: DONG BANG SHIN KI. They have a fan club of more than 800 thousand in Korea ALONE --that's not including the rest of the world!
{i am a proud member. tehehe..}
When I told some K-Pop fans that I hung-out with TVXQ, I was immediately rushed and touched as though 'I' were them! I guess I didn't realize how FAMOUS they were at the time. Lol. {wth did you expect? they're like 'Gods' to us. lol}
Well, if you're looking for a festival you can go to for great dancing, great singing, and lots of excitement...then I HIGHLY recommend the ASIA SONG FESTIVAL!
{i do too! i will go to the Asia Song Festival one of these days, but i HAVE been to a concert with DBSK performing in LA. so much money used, so worth it. <3}
p.s. When I returned to the United States, I came across tons of blogs asking about a particular picture with TVXQ and myself (click on link for picture).
{tehehe...they're tall, just to tell you.}
People were asking why TVXQ was looking so mad or confused. It was neither. During the time of this picture, I was talking to my producer regarding my position in reference to the camera. Since TVXQ didn't speak English, they were just waiting for the translator (not in frame) to tell them what we were talking about. :-)
{they know very little english, don't mind that. they'll learn. ^^ but Yoochun still knows enough to do a basic conversation.}
I had a GREAT time hanging out with them. They are all COOL dudes! We were laughing and joking around with each other almost the whole time. I hope I answered some of the questions that were asked. If I missed any... hit me up on my blog, and we'll talk!
Nate
Even Nate loves them. Why can't the rest of America be willing to give them a try?
Freaking...you know what, no, i'm happy reading this and i'm not killing my mood.
^__^ DBSK will always be the best. <3

[NEWS] 12.o3.o8: TVN E-News - DBSK has 2008's #1 Best Income
THEY'RE RICH.
They get to keep money! FINALLY.
Stupid...greedy...boss...producer...old man...>=O
But this was somewhat expected. They're DBSK for heaven's sake.
I knew this year would be good to them. ^^
I think i'm paranormal at times.
I can see the future in my dreams...but then again..
I dream very rarely.
Anyways, back to the guys being rich.
ANYONE THINKING OF ROBBING THEM,
PREPARE FOR A DEATH PENALTY.
If not from me, from the rest of us Cassiopeians. <3
Article:
CD Sales from Korea and Japan added together was about $5,392,000 USD taking out payment for the composer/producing/company. The money DBSK themselves made, they sold 674,000 records this year. 1 album from Korea and rest Japan. (But it might not be accurate because CD cost is different in Japan then the cost of CD in Korea so probably they made around 6 or 7 million.)
Made $29,000,000 in just concert venue NOT INCLUDING KOREA.. (Only stats from japan, china, Taiwan.)
Have circled 60 times around the globe by airplane.
CF/sponsoring $800,000 dollars each guarantee as spokes models…
They've made 31M 792 thousand USD dollars in 2008 alone +/- upcoming money, sponsors, extra CD sales. This is just so far.

[NEWS] SM to Release "Clean" Version of 'MIROTIC'
SM Entertainment finally decided to release the edited version of TVXQ’s 4th album entitled MIROTIC as a response to warning issued by Korea’s Commission of Youth Protection.
Staff from SM Entertainment, on December 2nd, said “Commission of Youth Protection" has determined MIROTIC as one of the songs that are banned, therefore we will release and edited version. However, this decision will not necessarily satisfy Commission of Youth Protection because they have their own measure apart, but this step must be made to prevent further effects."
‘Jumun’, ‘nol kajjeosso’, then ‘i got you under my skin’ and some words in the song are stated as ‘lyrics that can be harmful to teenagers’ by Commission of Youth Protection. The new version (edited version) of MIROTIC can be seen as soon as possible in TVXQ’s next activities.

LOL his eyes look huge. XD
was he shocked? or happy? or being a weirdo like his dorky self. XD
[NEWS] DBSK'S Mirotic Banned.
Apparently, their lyrics are too much for the government over there.
Wth...it's not even that bad! What about all the other crap people sing?
Why aren't those songs banned? They're way much worse.
But noooo~ It has to be DBSK.
They're jealous that DBSK is making too much money off this album.
So they've limited the buyers to people 19 and up.
Younger fans can just get family, friends or someone else to buy it for them. x]
This little "banned" issue will make the album even more popular.
Korea's Government has some serious issues.
But what can we do but accept it.
I still think it's ridiculous O_O
